Writ Petition is filed under Article 226 of Constitution of India,
praying to issuance of Writ of Mandamus, directing the respondent to
provide police protection to celebrate ”Aadi Perunthiruvizha” Scheduled
to be held on 05.08.2025 to 12.08.2025 in a peaceful and religious
manner.

The Writ Petition has been filed seeking for issuance of Writ of Mandamus, directing the respondent to provide Police protection to

celebrate “Aadi Perunthiruvizha” scheduled to be held from 05.08.2025

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for respondent and perused the materials available on record,

The grievance of the petitioner is that the petitioner is one of the devotees of the Temples Arul Mighu Veeramaathi Amman Temple, Arul Mighu Vinayagar Temple and Arul Mighu Plague Mariamman @ Lakshmiamman Temple, situate at Paapampatti Village, Sulur Taluk, Coimbatore District. The petitioner and several devotees of the said Temples decided to celebrate “Aadi Perunthiruvizha” from 05.08.2025 to 12.08.2025 and hence, the petitioner and others made a representation dated 07.07.2025 to the respondent-Police seeking permission to use loud speaker in the function and also to provide Police protection to conduct the said festival in a peaceful and religious manner without any hindrance from any persons, who are adverse to the interest of the said Temples. Despite the representation being received by the respondent-Police on 08.07.2025, the same has not been considered.

It is seen from the records that since the petitioner made the representation well in advance i.e., on 07.07.2025, till date, the respondent-Police have not passed appropriate orders on the said representation. Therefore, this Court directs the respondent-Police to provide adequate Police protection. for performing “Aadi Perunthiruvizha” which is scheduled to be held from 05.08.2025 to 12.08.2025 in a peaceful manner by imposing reasonable conditions.

In future, if the officer in-charge of the Police Station, receives any representation seeking to conduct Temple festival etc., they shall consider the same within seven (7) days from the date of receipt of the said representation, failing which, the Superintendent of Police concerned shall take departmental action against the Officers concerned, those who have not considered the representation till the fag end of the day and dragging the public to approach the Court unnecessarily for getting permission to conduct such Temple festivals. In the nature ofsuch Temple festivals, the public are collecting a very meagre funds for WEB COperforming poojas and conducting festivals. If the respondent-Police failed to consider such representations within the time, the parties will have to spend the collected money for filing appropriate petitions seeking permission from the Court to conduct such festival, which makes the parties to run from pillar to post to get appropriate remedy and in case this happens in future, the Investigating Officer, who received the representation will have to bear the expenses for conducting such Temple festivals.

6. With the above observations and direction, the Writ Petition is disposed of. There shall be no order as to costs
